{"id":976,"date":"2009-03-28T07:35:53","date_gmt":"2009-03-27T23:35:53","guid":{"rendered":"http:\/\/nick.onetwenty.org\/?p=976"},"modified":"2009-03-28T16:41:23","modified_gmt":"2009-03-28T08:41:23","slug":"copying-isnt-theft","status":"publish","type":"post","link":"https:\/\/nick.onetwenty.org\/index.php\/2009\/03\/28\/copying-isnt-theft\/","title":{"rendered":"Copying isn&#8217;t theft"},"content":{"rendered":"<p>Let&#8217;s contrast two videos concerning copying media.<\/p>\n<p>The first is an Australian Government advertisement targeted at young people and equating downloading movies to physical property crime:<\/p>\n<p><object width=\"425\" height=\"344\"><param name=\"movie\" value=\"http:\/\/www.youtube.com\/v\/HmZm8vNHBSU&#038;hl=en&#038;fs=1\"><\/param><param name=\"allowFullScreen\" value=\"true\"><\/param><param name=\"allowscriptaccess\" value=\"always\"><\/param><\/object><\/p>\n<p>Here are the words that appear during the video (copied from the YouTube page):<\/p>\n<blockquote><p>\nYou wouldn&#8217;t steal a car,<br \/>\nyou wouldn&#8217;t steal a handbag,<br \/>\nyou wouldn&#8217;t steal a television,<br \/>\nyou wouldn&#8217;t steal a movie.<\/p>\n<p>Downloading pirated films is stealing,<br \/>\nstealing is against the law,<br \/>\nPIRACY IT&#8217;S A CRIME\n<\/p><\/blockquote>\n<p>Here&#8217;s a video of <a href=\"http:\/\/www.jonathanmann.info\/\">Jonathan Mann<\/a> (of <a href=\"http:\/\/www.mannmade.tv\/\">geek-culture videos<\/a> fame) singing <a href=\"http:\/\/blog.ninapaley.com\/\">Nina Paley&#8217;s<\/a> (creator of <a href=\"http:\/\/www.sitasingstheblues.com\/\">Sita Sings the Blues<\/a>, an animated film that won&#8217;t get released because it uses compositions from the 1920s which are controlled under Intellectual Property laws) &#8220;The Copyright Song&#8221;:<\/p>\n<p><object width=\"480\" height=\"295\"><param name=\"movie\" value=\"http:\/\/www.youtube.com\/v\/zMP3QOlWV64&#038;hl=en&#038;fs=1\"><\/param><param name=\"allowFullScreen\" value=\"true\"><\/param><param name=\"allowscriptaccess\" value=\"always\"><\/param><\/object><\/p>\n<p>Here are the lyrics to that song (and a link to the Nina&#8217;s original video):<\/p>\n<blockquote><p>Copying isn&#8217;t theft.<br \/>\nStealing a thing leaves one less left.<br \/>\nCopying it makes one thing more.<br \/>\nThat&#8217;s what copying&#8217;s for.<br \/>\nCopying isn&#8217;t theft.<br \/>\nIf I copy yours, you have it too.<br \/>\nOne for me and one for you.<br \/>\nThat&#8217;s what copies can do.<br \/>\nIf I steal your bicycle, you have to take the bus.<br \/>\nBut if I just copy it, there&#8217;s one for each of us.<br \/>\nMaking more of a thing, that is what we call copying.<br \/>\nSharing ideas with everyone.<br \/>\nThat&#8217;s why copying is fun.<\/p><\/blockquote>\n<p>Sounds a lot less sensationalist and fear-mongering to me. Maybe the Australian Government should run a more reasonable campaign aimed at proponents of restrictive copyright laws. They can use the following text with their original video (I won&#8217;t sue them for copying it):<\/p>\n<blockquote><p>\nYou can&#8217;t copy a car,<br \/>\nYou can&#8217;t copy a handbag,<br \/>\nYou can&#8217;t copy a television,<br \/>\nYou can copy a movie,<\/p>\n<p>Downloading pirated films creates a copy of a video while keeping the original completely intact,<br \/>\nWe need to reform our laws so that they appreciate the difference between stealing and copying and don&#8217;t <a href=\"http:\/\/www.news.com.au\/heraldsun\/story\/0,21985,23308632-2902,00.html\">criminalise<\/a> the <a href=\"http:\/\/www.itwire.com\/content\/view\/23047\/1231\/\">general population<\/a>,<br \/>\nIGNORANCE: IT&#8217;S A CRIME\n<\/p><\/blockquote>\n<p>If you are interested in reading more about Nina Paley&#8217;s current legal problems with Sita Sings the Blues, <a href=\"http:\/\/questioncopyright.org\/\">QuestionCopyright<\/a> has a long <a href=\"http:\/\/questioncopyright.org\/nina_paley_sita_interview\">interview with Nina Paley<\/a>. They also have a <a href=\"http:\/\/www.youtube.com\/user\/questioncopyright\">YouTube channel<\/a> with other small videos.<\/p>\n<p>Piracy is a complex issue that can&#8217;t be simply reduced to &#8220;stealing&#8221; and &#8220;protecting intellectual property&#8221;. We need to reasonably weigh economic considerations against freedoms (to create and share).<\/p>\n<p>Here is a set of questions worth considering:<\/p>\n<p><em><\/p>\n<ul>\n<li>Should piracy for personal use be decriminalised if the majority of the population generally feel that it&#8217;s &#8220;okay&#8221;?<\/li>\n<li>Is it ethical for news corporations to regulate, moderate, and censor the spread of information?<\/li>\n<li>If you could copy a car for personal use, should the automotive industry be allowed to stop you?\n<li>If the poor could copy food as easily as you could copy music, would it be ethical for the farming industry to stop them?<\/li>\n<\/ul>\n<p><\/em><\/p>\n<p>Copying of digital material is cheap and easy. With new technologies, copying of physical objects will eventually become the same. At that point, copyright holders will be looking at digital copyright laws (that we are yet to write) to determine if people can copy &#8220;real&#8221; things.
